1.1 "PELLICCERIA TOMENFUR": è il negozio on-line che intende effettuare la vendita tramite Internet dei prodotti appartenenti al proprio assortimento.;
1.2 "Prodotti": sono tutti i prodotti e/o le merci commercializzati dalla PELLICCERIA TOMENFUR e facenti parte del proprio assortimento.
1.3 "Cliente": è l'acquirente dei Prodotti che riveste lo status di consumatore, intendendosi per tale la persona fisica e giuridica che compie l'acquisto per scopi non riferibili all'attività commerciale o professionale eventualmente svolta.

2. Ambito di applicazione – Effetti
2.1 Le Condizioni Generali costituiscono parte integrante di qualsivoglia proposta, ordine di acquisto e conferma d'ordine di acquisto dei Prodotti commercializzati da PELLICCERIA TOMENFUR in vigore alla data del relativo ordine.
2.2 Le Condizioni Generali concernono esclusivamente la vendita ad un Cliente consumatore, come sopra specificato.
3. Formalizzazione contrattuale
3.1 Tutti i contratti vengono conclusi esclusivamente con l'accesso da parte del Cliente al Sito, impiegando la tecnologia di comunicazione a distanza attraverso la rete Internet.
3.2 Tutti gli ordini di acquisto trasmessi a PELLICCERIA TOMENFUR devono essere esattamente completati in ogni loro parte e devono contenere gli elementi necessari per l'esatta individuazione dei Prodotti ordinati, del Cliente e del luogo di consegna dei Prodotti.
3.3 L'ordine di acquisto trasmesso a PELLICCERIA TOMENFUR vale come proposta contrattuale del Cliente manifestata online.
3.4 La conferma d'ordine da parte di PELLICCERIA TOMENFUR, trasmessa al Cliente all'indirizzo di posta elettronica da questi indicato, conferma i dati dell'ordine e vale come accettazione di proposta contrattuale.
3.5 Il contratto si intende concluso, ed è vincolante per entrambe le parti, nel momento in cui la conferma d'ordine di acquisto è inviata al Cliente.
3.6 PELLICCERIA TOMENFUR si riserva la facoltà di non accettare ordini incompleti o non debitamente compilati.
4. Tempi e modalità di consegna
4.1 PELLICCERIA TOMENFUR provvede a recapitare al Cliente i Prodotti, selezionati ed ordinati con le modalità di cui al precedente articolo, a mezzo di corriere.
4.2 La consegna viene effettuata all'indirizzo specificato al momento dell'ordine che può essere diverso dall'indirizzo del committente.
4.3 In ogni caso, i tempi di consegna, secondo quanto disposto dall'art. 54 del D. Lgs. n. 206/2005, non sono superiori a 15 giorni a decorrere dal giorno successivo a quello di trasmissione dell'ordine a PELLICCERIA TOMENFUR.
4.4 Il Cliente che desidera modificare l'indirizzo di consegna della merce, dopo che ha inoltrato l'ordine, può contattare il Servizio Clienti, nella sezione "Contatti", tramite e-mail e richiedere il cambio: la richiesta sarà accolta se l'ordine non è stato ancora evaso.
4.5 I costi di consegna dei Prodotti sono a carico del Cliente, salvo promozioni in corso.
4.6 La consegna dei Prodotti è subordinata al pagamento, da parte del Cliente, del relativo prezzo con il mezzo scelto tra quelli messi a disposizione da PELLICCERIA TOMENFUR.
4.7 Condizioni e termini di consegna diversi da quelli previsti nelle Condizioni Generali devono essere preventivamente concordate tra il Cliente e PELLICCERIA TOMENFUR e da quest'ultima accettate per iscritto.
5. Prezzi
5.1 Tutti i prezzi di vendita dei Prodotti indicati nel Sito sono espressi in Euro.
5.2 Salvo ove diversamente indicato, i prezzi dei Prodotti sono comprensivi di IVA.
5.3 I prezzi dei singoli Prodotti, di volta in volta indicati nel Sito, annullano e sostituiscono i precedenti.
5.4 I prezzi applicati sono quelli indicati nel Sito al momento dell'ordine di acquisto da parte del Cliente.
6. Responsabilità di PELLICCERIA TOMENFUR
6.1 PELLICCERIA TOMENFUR non assume alcuna responsabilità inerente all'uso che il Cliente intende fare della merce acquistata. In caso di merce "difettosa" l'unico onere a carico di PELLICCERIA TOMENFUR sarà quello della sua sostituzione.
7. Obblighi del cliente
7.1 Il Cliente si impegna, una volta conclusa la procedura di acquisto online, a provvedere alla stampa ed alla conservazione delle presenti Condizioni Generali.
7.2 Le informazioni contenute nelle Condizioni Generali vanno visionate ed accettate dal Cliente prima dell'invio dell'ordine di acquisto, ciò al fine di soddisfare integralmente la condizione di cui agli artt. 52 e 53 del D. Lgs. n. 206/2005. L'accettazione avviene mediante marcatura dell'apposito spazio presente sul Sito. In mancanza di ciò, l'ordine non potrà essere eseguito.
8. Diritto di recesso
8.1 Il Cliente che desidera annullare l'ordine inviato, può contattare il Servizio Clienti nella sezione "Contatti" tramite e-mail e richiedere l'annullamento: la richiesta sarà accolta se l'ordine non è stato ancora evaso.
8.2 Ai sensi dell'art. 64 del D. Lgs. n. 206/2005, il Cliente ha diritto di recedere dal contratto stipulato e di restituire i Prodotti ordinati eventualmente già consegnati, senza alcuna penalità e senza specificarne il motivo.
Tuttavia, inviando le misure per la realizzazione del capo artigianale, il Cliente è consapevole dell’articolo 55 del D.L.185/99 che esclude esplicitamente dall’esercizio del diritto di recesso i capi su misura o chiaramente personalizzati.
8.3 Il diritto di recesso deve essere esercitato dal Cliente, a pena di decadenza, con l'invio di una comunicazione scritta a Tomenfur Pellicceria di Umberto Pepe con sede Via Francesco Briganti, 74/B, 06127 Perugia PG, Italy, P.Iva 03050220544 mediante lettera raccomandata con avviso di ricevimento, entro il termine di dieci giorni lavorativi decorrenti dal ricevimento dei Prodotti.
8.4 La comunicazione di cui sopra può essere inviata, entro lo stesso termine, anche mediante telegramma, telex, posta elettronica, purché confermata, mediante lettera raccomandata A.R., entro le 48 ore successive all'invio del telegramma o del telex o del messaggio di posta elettronica.
8.5 Con la ricezione da parte di PELLICCERIA TOMENFUR della comunicazione con cui il Cliente manifesta la volontà di recedere, le parti sono sciolte dalle rispettive obbligazioni derivanti dal contratto e dalla proposta contrattuale, fatte salve, nell'ipotesi in cui le obbligazioni stesse siano state nel frattempo in tutto o in parte eseguite, le obbligazioni previste dall'art. 67 del Decreto Legislativo n. 206/2005. Se il recesso è effettuato in ossequio alle condizioni sopra indicate, PELLICCERIA TOMENFUR procederà al rimborso delle somme versate dal Cliente, ivi comprese le eventuali somme versate a titolo di caparra. Il rimborso verrà effettuato a scelta del Cliente mediante:
a) bonifico bancario su conto a lui intestato;
8.6 Il rimborso è gratuito ed è effettuato nel minor tempo possibile, e in ogni caso entro 30 giorni dalla data in cui PELLICCERIA TOMENFUR viene a conoscenza dell'esercizio del diritto di recesso da parte del Cliente. Le somme si intendono rimborsate nei termini qualora vengano effettivamente restituite, spedite o riaccreditate con valuta non posteriore alla scadenza del termine precedentemente indicato.
8.7 I prodotti resi devono essere restituiti alla PELLICCERIA TOMENFUR entro 10 giorni lavorativi decorrenti dalla data di consegna al Cliente. Ai fini della scadenza di detto termine la merce si intende restituita nel momento in cui viene consegnata all'ufficio postale accettante o allo spedizioniere.
8.8 I Prodotti resi devono essere restituiti integri e nella confezione originale.
8.9 In caso di esercizio del diritto di recesso tutte le spese per la restituzione dei prodotti ad PELLICCERIA TOMENFUR sono esclusivamente a carico del cliente.
9. Garanzia prodotti
9.1 PELLICCERIA TOMENFUR, ai sensi e per gli effetti della Direttiva europea 44/99/CE e del Decreto legislativo italiano n. 206/2005 (Codice del consumo), presta al Cliente consumatore una garanzia legale sul prodotto acquistato per qualsiasi difetto di conformità rispetto al contratto di vendita che si manifesti entro il termine di 24 (ventiquattro) mesi dalla consegna all'Acquirente del prodotto.
9.2 La garanzia legale consente al Cliente, in caso di difetti di conformità del prodotto, di ottenere, rivolgendosi direttamente a PELLICCERIA TOMENFUR, in tempi ragionevoli tenendo in considerazione la natura del prodotto, la riparazione (se ed in quanto possibile), la sostituzione del prodotto, la riduzione del prezzo o la risoluzione del contratto.
9.3 Non è in ogni caso coperto da garanzia l'utilizzo del prodotto non conforme a quello proprio del prodotto e alle istruzioni/avvertenze in merito fornite da PELLICCERIA TOMENFUR.
9.4 L'eventuale segnalazione di un difetto di conformità del prodotto va presentata unitamente alla prova dell'avvenuto acquisto del prodotto dal Cliente (documento fiscale emesso da PELLICCERIA TOMENFUR o ricevuta di pagamento).
9.5 Nell'ambito del termine di cui al precedente par. 9.1, la segnalazione di un difetto di conformità va inviata dal Cliente entro e non oltre 2 (due) mesi dalla data in cui il difetto di conformità è stato riscontrato.
9.6 La segnalazione del difetto di conformità dovrà essere inoltrata dal Cliente e ad PELLICCERIA TOMENFUR via posta elettronica all'indirizzo tomenfur.pellicceria@gmail.com; PELLICCERIA TOMENFUR comunicherà prontamente al Cliente le modalità attraverso le quali riconsegnare o mettere a disposizione il prodotto.
9.7 PELLICCERIA TOMENFUR, tramite il proprio servizio di assistenza, effettuerà i controlli qualitativi atti a verificare l'effettiva non conformità del prodotto e fornirà un riscontro al Cliente via posta elettronica all'indirizzo che il Cliente ha fornito nel corso del processo di registrazione al Sito.
9.8 In caso di non conformità accertata del prodotto, PELLICCERIA TOMENFUR provvederà a rimborsare il Cliente dei costi di spedizione sostenuti per la riconsegna del prodotto non conforme e, senza alcun costo a carico del Cliente, a riparare il prodotto o a sostituirlo con un nuovo prodotto; in tale ultima ipotesi, il prodotto non conforme e sostituito resterà di proprietà di PELLICCERIA TOMENFUR.
9.9 Il suddetto rimborso verrà effettuato mediante bonifico bancario a favore del Cliente. Sarà onere del Cliente comunicare ad PELLICCERIA TOMENFUR, sempre via posta elettronica all'indirizzo tomenfur.pellicceria@gmail.com, gli estremi bancari per effettuare il bonifico a suo favore e per far sì che PELLICCERIA TOMENFUR sia messa nella condizione di poter restituire la somma dovuta.
9.10 Alla garanzia legale di cui al presente articolo, in ogni caso prestata al Cliente consumatore da PELLICCERIA TOMENFUR, potrà eventualmente affiancarsi un'ulteriore ed autonoma garanzia convenzionale.
9.11 Il Cliente che acquista da PELLICCERIA TOMENFUR ha diritto a restituire i prodotti acquistati e richiedere la sostituzione della merce in caso di loro eventuale danneggiamento durante il trasporto o la rottura dei sigilli. Questo diritto deve essere esercitato dal Cliente, a pena di decadenza, entro e non oltre due giorni dal ricevimento del pacco, contattando PELLICCERIA TOMENFUR così come indicato al punto 13.2.
10. Modalità di pagamento
10.1 Il Cliente può pagare i Prodotti ordinati mediante: - account PayPal; - carta di credito; In ogni caso, al fine di consentire a PELLICCERIA TOMENFUR l'emissione della fattura, il cliente deve compilare il form di Registrazione inserendo tutti i dati richiesti e necessari.
10.2 Il pagamento con carta di credito avviene tramite un collegamento diretto con i sistemi di pagamento di PayPal. Si applica l'art. 56 del Decreto Legislativo n. 206/2005.
11. Promozioni e regali
11.1 Le Promozioni proposte da PELLICCERIA TOMENFUR sono valide fino ad esaurimento delle scorte dei Prodotti e nei limiti di acquisto indicati nel Sito.
11.2 Le Promozioni non sono cumulabili.
11.3 Qualora l'Offerta Speciale promossa da PELLICCERIA TOMENFUR preveda l'invio di un Prodotto in omaggio insieme ad uno o più Prodotti acquistati, il Cliente riceve il Prodotto in omaggio solo dietro esplicita accettazione dello stesso, manifestata con l'inserimento in carrello.
11.4 L'offerta del Prodotto in omaggio vale fino ad esaurimento delle scorte.
11.5 Nessuna sostituzione o reso è possibile in relazione ad eventuali Prodotti ricevuti in omaggio dal Cliente.
12. Controversie
12.1 Ogni controversia relativa alla applicazione, esecuzione, interpretazione e violazione del contratto stipulato online dal Cliente con PELLICCERIA TOMENFUR, è sottoposta alla giurisdizione italiana.
12.2 Per qualsiasi controversia tra le parti in merito è competente il Foro del luogo della sede legale di PELLICCERIA TOMENFUR
13. Legge applicabile e rinvio
13.1 I contratti stipulati online dal Cliente con PELLICCERIA TOMENFUR sono regolati dalla legge italiana.
13.2 Per quanto qui non espressamente disposto, valgono le norme di legge applicabili ai rapporti ed alle fattispecie previste nel contratto stipulato online dal Cliente con PELLICCERIA TOMENFUR.
